REGULATION FOR OVERSTAY R.O.C. NATIONALS WITHOUT CITIZENSHIP APPLYING FOR RESIDENCE CERTIFICATE

For those who legally and continuously stayed in Taiwan for more than 7 years with at least 183 days or more per year.


Requirements:
1. Application Form and picture
2. Identification Certificate (ex. Birth Certificate)
3. Passport
4. Police Clearance (Taiwan) / NBI Clearance (Philippines)
5. Medical Examination (valid for 3 months)
6. NT$400.00

Processing of application:
1. If the applicant is in Taiwan, he/she will be notified about the processing of the papers after 15 days. If the applicant is applying from abroad, he/she will be notified after 3 months.
2. All documents from abroad should be verified in TECO.

Qualifications of overstay ROC nationals without citizenship to apply for Residence Certificate:
1. He/She who has legally and continuously stayed in Taiwan for 7 years (with at least 183 days or more per year) without criminal records can apply for Residence Certificate (RC) after paying the penalty.
2. He/She who has legally and continuously stayed in Taiwan for 7 years (with at least 183 days or more per year) with criminal records must will leave Taiwan after paying the penalty and can come back to Taiwan after 5 years to apply for Residence Certificate (RC).
3. He/She who has not stayed legally or continuously in Taiwan for 7 years (with at least 183 days or more per year) leave Taiwan after paying the penalty and can come back to continue his/her stay until qualified to apply for Residence Certificate (RC).
